GAP Studios Terms and Conditions for Photography Experiences of Portrait Sessions.

 

Session booking:

To secure your session time, a fully refundable holding deposit of $99 is required.

This applies to all portrait sessions.

Your holding deposit will be refunded in full unless you:

- Reschedule your session more than once.

- Do not show up for your scheduled session.

- Cancel your original session without rescheduling it first.

- Any cancelation or rescheduling request must be made more than 72 hours from the session day and time.

- GAP Studio Experiences are valid for 60 days from the date you receive it.

 

What does a complimentary photography experience include?

It includes a complimentary photoshoot in studio with a photographer.

The photo shoot is valued at $150.

It includes a viewing session for you to see an edit of the images taken by the photographer.

You can choose one image to be produced into an 8x10ā€ matted print. The print is valued at $650.

There is no obligation to purchase any further images.

Any additional images need to be purchased at the designated retail price.

We have multiple artwork sizes and image packages that can be customised to suit your needs.

If you choose to purchase additional images instead of the single complimentary 8x10ā€ matted print, the $650 value from the complimentary print can be used as a credit towards any of the purchased images or packages.

Each experience is valid for a session with up to 15 participants.

Additional participants may be subject to a fee.

This experience cannot be used with any other offer, redeemed for cash, or used in any other way than described in your Experience.

This experience cannot be used to purchase images from a previous photography session.

Our experiences are valid for complete family groups only. Unfortunately, we cannot accept partial families to avoid any potential disappointment.

Only one Gift Experience may be redeemed per family per year.

Sessions and/or gifts are non-transferable and can only be used by the person it is registered to. It cannot be sold or given to another family member, friend, or individual.

 

Sales terms and conditions:

If you place an order with GAP Studios it will have the following terms and conditions.

We retain the copyright to all imagery and reserve the right to use it for displays, exhibitions or promotional/marketing purposes.

All imagery will go through retouching, smoothing skin and removing non-permanent marks.

Any other requests must be made at the time of your order and specified on the order form.

Your order will be ready 8 weeks from the day your order is placed.

 

Warranty policy:

If your order arrives to you damaged and cannot be used for its intended use. We will replace the item free of charge.

If your framed products are damaged or lost in a disaster such as fire, flood, earthquake, explosion, or moving house. We will replace your framed products for any of these reasons for a 100-year period from your purchase date.

The production period for these replacements is 8 weeks.

 

Refund policy:

GAP Studios creates a custom bespoke order especially for you.

Under Australian Consumer Law there is no cooling off period and a no refund policy.

However, at Gap Studios we offer a 48 hour amendment period. Within 48 hours of your order you can contact us in writing to amend your order.

After this 48 hour period your order cannot be changed or amended.

 

Payment plan options:

Gap Studios offers customers two payment plan options to help you pay off the cost of your images over a period of time.

Option 1: Payright

Payright is a third party buy-now, pay later provider service that is available to you.

They offer flexible payment terms for periods up to 36 months.

For orders with a value up to $10,000.

Option 2: Gap Studios Internal payment plans

Gap Studios offers 6 or 12 month payment plans.

With a choice of either weekly, fortnightly or monthly payment installments.

All installments are interest-free.

For orders with a value up to $5,000.

The payment plan will be authorised by you via signature on the sale invoice.

The authorised installments must be direct debited from a nominated credit card as outlined on the sale invoice until the balance of the invoice is paid off.

All installments outlined in your payment plan will be debited as per the payment schedule starting on the nominated date on the sales invoice.

Once you have paid 20% of your invoice total you will be attempted to be converted to Payright. If for any reason you are not converted to Payright, your payments will continue to be charged to your credit card in line with the payment schedule until your debt is fully paid.

Any physical artwork products ordered will be shipped to you once you reach 30% of your invoice total.

Any digital images ordered will be sent to you via a digital link upon completion of your payment plan.

If you wish to make additional payments or pay out your payment plan, you can do this at any point.

Defaulting on the payment plan:

If your scheduled payment is declined. Gap Studios will attempt to re-process that scheduled payment on the next business day.

Should this 2nd payment decline 14 days from this date Gap Studios will issue you with a notice to rectify the payment within 14 days.

If your account is not updated within the 30 days from the original notice to rectify. We reserve the right to allocate your overdue payments to a debt collection process. Any fees associated with this will be at your cost.

If any payment to your Credit Card is unsuccessful, a dishonor fee of $25 per unsuccessful payment will be added to your account.

In the event of any change to your Credit Card number or Credit Card expiry for either the principal or Supplementary Credit Card(s) used for your Recurring Payment Plan, you must notify the studio accordingly.

Gift vouchers:

All gift vouchers are valid for a period of 3 years after the date of purchase.

 

Privacy Policy:

At GAP Studios, we take your privacy seriously and are committed to protecting it. Our collection, storage, use, disclosure, and handling of your personal information is in accordance with the Privacy Act 1988 and the 13 Australian Privacy Principles under the Act.

This policy outlines our approach to your personal information and may be updated from time to time.

What personal information does GAP Studios collect and why?

Personal information refers to information or an opinion about an identified or reasonably identifiable individual. During the provision of our services and products, we may collect personal information such as:

- Contact and identification information such as your name, address, telephone/mobile numbers, and email address;

- Credit card and other banking information for payment facilitation of our services and/or products;

- Images of you included in photographic materials; and

- Other information such as your hobbies or interests for personalisation of your photography session.

 In some cases, we may also hold additional personal information provided by you. We assure you that your personal information will be collected and handled in accordance with the Privacy Act and the Australian Privacy Principles.

How does GAP Studios collect personal information?

Generally, GAP Studios collects your personal information directly from you, through:

- The completion of a manual or online form, such as an application form on GAP Studios website or a promotional form on social media platforms;

- An interaction or exchange in person, such as through a face-to-face meeting, or by way of telephone, facsimile, email, post or through the use of the GAP Studios website; and/or

- When you enter a GAP Studios competition/promotion through affiliates, online offers or events.

There may be occasions when GAP Studios collects your personal information from other sources such as from:

- Third parties with which GAP Studios does business;

- An information services provider;

- A publicly maintained record or other publicly available sources of information including social media and similar websites.

 Generally, GAP Studios will only collect your personal information from sources other than you if it is unreasonable or impracticable to collect your personal information from you.

Why does GAP Studios need your personal information?

GAP Studios collects, holds, uses and discloses your personal information where it is reasonably necessary for the purposes of:

- Providing to you personalised photography services and photography products, including processing your orders or applications and dealing with requests, enquiries or complaints and other customer care-related activities;

- Issuing to you your GAP Studios Experience;

- Accounting, billing, and other internal administrative and business management purposes; and carrying out market and product analysis.

GAP Studios may also use your personal information, including your image, quotes or other information for inclusion with our marketing materials, where you have consented to such use.

GAP Studios may use your personal information for purposes related to the above purposes and for which you would reasonably expect GAP Studios to do so in the circumstances, or where you have consented or the use is otherwise in accordance with law. Where personal information is used or disclosed, GAP Studios takes steps reasonable in the circumstances to ensure it is relevant to the purpose for which it is to be used or disclosed.

You are under no obligation to provide your personal information to GAP Studios. However, without certain information from you, GAP Studios may not be able to provide its services and/or products to you.

 Direct Marketing:

GAP Studios may use and disclose your personal information in order to inform you of services and/or products that may be of interest to you from GAP Studios. In the event you do not wish to receive such communications, you can e-mail us at assistant@gapstudios.com.au to opt-out. Please ensure you opt-out with the email you have been registered with.

To whom does GAP Studios disclose your personal information?

GAP Studios discloses your personal information for the purpose for which GAP Studios collects it, as set out above. This may include disclosing your personal information to:

- Third parties engaged to perform administrative or other services on behalf of GAP Studios;

- Third parties for the provision of financial services, if and to the extent that customers choose to use such services.

- People or entities considering acquiring an interest in GAP Studios enterprise or assets or otherwise working with GAP Studios to facilitate the provision of its services and/or products;

- GAP Studios professional advisors, contractors, consultants, and related bodies corporate.

Disclosures to third parties are on a confidential basis or otherwise in accordance with law. GAP Studios may also disclose your personal information with your consent or if disclosure is required or authorised by law. Security of your Personal Information GAP Studios takes steps reasonable in the circumstances to ensure that the personal information it holds is protected from misuse, interference, and loss and from unauthorised access, modification or disclosure. GAP Studios holds personal information in both hard copy and electronic forms in secure databases on secure premises, accessible only by authorised staff. GAP Studios will destroy or de-identify personal information in circumstances where it is no longer required unless GAP Studios is otherwise required or authorised by law to retain the information.  

How to access and correct your personal information?

GAP Studios takes steps reasonable in the circumstances to ensure personal information it holds is accurate, up-to-date, complete, relevant and not misleading. Under the Privacy Act, you have a right to access and seek correction of your personal information that is collected and held by GAP Studios.

GAP Studios will grant access to your personal information to the extent required or authorised by the Privacy Act or other law and take steps reasonable in the circumstances to correct personal information where necessary and appropriate.

To obtain access to your personal information:

- You will have to provide proof of identity to ensure that personal information is provided only to the correct individuals and that the privacy of others is protected;

- GAP Studios requests that you be reasonably specific about the information you require;

 

Privacy Complaints:

Please direct all privacy complaints to GAP Studios Privacy Compliance Officer via email at assistant@gapstudios.com.au.

At all times, privacy complaints:

- will be treated seriously;

- will be dealt with promptly;

- will be dealt with in a confidential manner; and

- will not affect your existing obligations or affect the commercial arrangements between you and GAP Studios.

 

In the event that you are dissatisfied with the outcome of your complaint, you may refer the complaint to the Office of the Australian Information Commissioner.
